Atlas Creatives is a brand name used by Nadflair Agency LLC, an Illinois limited liability company with its business address at 5343 Belleville Crossing St, Unit 134, Belleville, IL 62226, United States. Nadflair Agency LLC is the parent company that owns and operates Atlas Creatives and this website.
In these terms, “we”, “us”, “our” and “Atlas Creatives” mean Nadflair Agency LLC. “You” means the person or business using this website or engaging our services. All services offered under the Atlas Creatives name are provided by Nadflair Agency LLC, and all proposals, contracts and invoices are issued by Nadflair Agency LLC.
02Accepting these terms
By using this website, or by accepting a proposal, quote or invoice from us, you agree to these terms. If you are agreeing on behalf of a business, you confirm you have authority to bind that business.
If a signed proposal or written agreement for your project says something different from these terms, the signed proposal or agreement takes priority for that project.
03Using this website
You may browse this website for your own information. You must not copy, reproduce or reuse our portfolio, designs, text or other content without our written permission; attempt to interfere with the website's security or operation; or submit false, misleading or unlawful information through our forms.
We aim to keep the information on this website accurate, but it is provided for general information and may change without notice. Prices and package inclusions shown on the website are those in effect when you accept your proposal.
04Our services and proposals
We provide website design and development, brand identity and graphic design, video production and editing, animation, marketing and content creation, and CRM and automation services.
Before any project begins, we provide a written proposal or quote describing the scope, deliverables, timeline and price. Work outside that scope is not included unless we agree to it in writing, and may be charged separately. Timelines are good-faith estimates and depend on you providing content, approvals and feedback on time.
05Website packages
Our fixed-price website packages — Starter, Growth and Signature — include the pages, features, revision rounds and post-launch support period described on our Pricing page and confirmed in your proposal.
- Revision rounds. A revision round is one consolidated set of feedback on a deliverable, which we implement together. Additional rounds may be quoted separately.
- Pages. A page is a distinct page with its own address. Individual blog posts and product listings are not counted toward page limits.
- Post-launch support covers fixing defects in the work we delivered and minor adjustments during the stated period. It does not include new features, new pages or redesigns.
- Not included. Domain registration, hosting, paid plugins, themes or apps, stock media and font licenses, and third-party subscriptions are not included unless your proposal says otherwise.
06Fees and payment
- Fees are as stated in your proposal or invoice, in US dollars, and exclude any applicable taxes.
- The payment schedule and accepted payment methods are set out in your proposal or invoice. Payments are made to Nadflair Agency LLC.
- We may pause work on a project while any invoice is overdue.
- We do not launch a website or release final files until the project has been paid in full.
- Third-party costs we incur on your behalf with your approval — such as licenses or subscriptions — are billed to you at cost unless agreed otherwise.
07Cancellations and refunds
Payments are fully refundable if you cancel before work begins. Once work has begun, payments are non-refundable and cover the work already underway. Our Refund Policy explains when work is considered to have begun and how to request a refund, and forms part of these terms.
08Your responsibilities
- Provide accurate information, content and timely feedback and approvals.
- Make sure you own, or have permission to use, everything you give us — including logos, text, photographs and trademarks — and that it does not infringe anyone else's rights.
- Review and approve deliverables before launch. Once you approve a deliverable, you are responsible for checking it is accurate, including any legal, regulatory or medical claims it contains.
- If a project is on hold because we are waiting on you for more than 30 days, we may reschedule it. If we are waiting for more than 60 days, we may close the project, and fees for the work completed remain payable.
09Ownership of the work
- Final deliverables. Once your project is paid in full, we transfer to you ownership of the final deliverables we created specifically for you.
- Before full payment, all work remains our property, and you may not use it.
- Third-party elements such as fonts, plugins, themes, stock media and software are licensed to you under their own license terms, not transferred by us.
- Our own tools. We keep ownership of our pre-existing materials, code libraries, templates, methods and know-how, and grant you a permanent license to use any of them that are built into your final deliverables.
- Unused concepts and drafts you did not select remain ours.
- Portfolio. We may show the work we create for you in our portfolio and marketing, unless you ask us not to in writing or we have signed a confidentiality agreement that says otherwise.
10Third-party products
Websites and systems we build often rely on third-party platforms, such as hosting providers, website builders, e-commerce, booking and CRM software. Those platforms are governed by their own terms. We are not responsible for their availability, pricing, policy changes or outages.
11Our commitments and disclaimers
We will perform our services with reasonable skill, care and diligence, consistent with good industry practice.
Marketing outcomes depend on many factors outside our control. We therefore do not guarantee specific results, such as search rankings, traffic, leads, sales or revenue. Except as stated in these terms, our services and this website are provided “as is”, and we disclaim all other warranties to the extent the law allows.
12Limitation of liability
To the extent permitted by law, our total liability to you for any claim relating to a project is limited to the fees you paid us for that project in the 12 months before the claim arose. We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost data or business interruption. Nothing in these terms limits liability that cannot be limited by law.
13Indemnity
You agree to indemnify Nadflair Agency LLC against claims, losses and costs arising from content or materials you supply to us, or from your use of the deliverables in breach of any law or third-party right.
14Confidentiality
Each of us will keep confidential any non-public business information the other shares in connection with a project, and use it only for that project, except where disclosure is required by law.
15Ending a project
Either of us may end a project by written notice if the other materially breaches these terms or the project agreement and does not fix the breach within 14 days of being asked to. If a project ends early, you pay for the work completed up to that point, and refunds are handled under our Refund Policy.
16Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in St. Clair County, Illinois, and both parties consent to those courts. Before starting any formal proceedings, we each agree to try in good faith to resolve the dispute by discussion first.
17General
- These terms, together with your proposal and our Refund Policy, are the entire agreement between us about our services.
- If any part of these terms is found unenforceable, the rest remains in effect.
- Neither of us is responsible for delays caused by events beyond reasonable control.
- We may update these terms. The version in effect when you accept your proposal applies to your project.
- Failing to enforce a right does not waive it.
